Terms of Service

1. Acceptance of terms

By registering for, accessing, or attending the "Power of the Subconscious Mind" live masterclass (the "Masterclass") operated by Blue Dot Transform Consulting Pvt. Ltd. ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not register or attend.

2. The service

The Masterclass is a paid, live, interactive online training session of approximately three hours, delivered by Avinash Anand Singh. It includes bonus materials (audio, written resources, and access to private communities) delivered within 24 hours of the live session.

The Masterclass is educational in nature and is intended for personal growth and mindset development. It is not therapy, counselling, medical care, or psychological treatment.

3. Eligibility

• You must be at least 18 years old to register and attend.
• You must provide accurate registration details (full name, valid email, valid mobile number).
• You are responsible for safeguarding any login link, code, or community access we send to you.

4. Registration & payment

• The Masterclass is offered at region-specific pricing shown at checkout:
  • India (INR): ₹199 base seat, optional add-on ₹499.
  • International (USD — UAE, UK, USA, Australia, Singapore, Malaysia): $7 base seat, optional add-on $11.
• Payments are processed by our payment partner (Razorpay). We do not store full payment card, bank, or wallet details on our servers.
• Your seat is confirmed only after successful payment and confirmation email / message.
• All fees are inclusive of applicable taxes unless stated otherwise. If a tax authority requires us to collect additional tax (VAT, GST, sales tax) at your location, we may adjust the checkout total to reflect it.
• Refunds are governed by our Refund Policy.

5. Participant conduct

By attending the Masterclass you agree:

• Not to record, screen-capture, livestream, or otherwise re-broadcast the Masterclass without our prior written consent.
• Not to share your unique join link, replay link, or community access with any other person.
• To engage respectfully with other participants, the host, and any moderators. Harassment, hate speech, spam, or solicitation may result in immediate removal without refund.
• Not to use the Masterclass, materials, or community for any unlawful, discriminatory, or fraudulent purpose.

6. Intellectual property

All content delivered through or related to the Masterclass — including frameworks, slides, audio, video, written materials, and any bonus resources — is the intellectual property of Blue Dot Transform Consulting Pvt. Ltd. or its licensors, protected under the copyright, trademark, and other laws of India and, where applicable, of your country of residence. You receive a personal, non-transferable, non-exclusive, revocable licence to use the materials solely for your own personal learning. You may not resell, redistribute, sublicense, repackage, adapt, or use any part of it to train machine-learning models.

7. Electronic communications & e-signatures

By registering you consent to receive communications from us electronically (email, WhatsApp, in-page notification). Your electronic acceptance of these Terms and any consent captured through our checkout constitutes a legally binding electronic signature under (as applicable to you): the Indian Information Technology Act 2000; the U.S. E-SIGN Act; the UK Electronic Communications Act 2000; the EU eIDAS Regulation; UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services; Australia's Electronic Transactions Act 1999; Singapore's Electronic Transactions Act 2010; and Malaysia's Electronic Commerce Act 2006.

8. Disclaimer

Individual results vary and depend on consistent practice, prior experience, and personal circumstances. We make no guarantees, express or implied, regarding any specific outcomes — financial, emotional, or otherwise. To the extent permitted by applicable law, the Masterclass is provided "as is" and "as available", without warranties of any kind — including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Consumer rights (UK, EU, USA, AUS, SG, MY)

Nothing in these Terms limits or excludes any non-waivable statutory rights you have as a consumer under the laws of your country of residence, including but not limited to:

• UK / EU: the Consumer Rights Act 2015 (UK), the Consumer Rights Directive (EU 2011/83), and (for digital content and services) the Digital Content Directive (EU 2019/770). Under EU/UK law you may have a 14-day right of withdrawal from distance contracts, subject to certain exceptions for digital content that you have expressly consented to receive before the withdrawal period ends (this is what happens when the live session is delivered).
• USA: non-waivable rights under applicable federal and state consumer-protection statutes.
• Australia: guarantees under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010) that goods and services are provided with due care and skill.
• Singapore: the Consumer Protection (Fair Trading) Act 2003.
• Malaysia: the Consumer Protection Act 1999.

10. Limitation of liability

To the maximum extent permitted by applicable law, Blue Dot Transform Consulting Pvt. Ltd., its directors, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — or for any loss of profits, revenue, data, or goodwill — arising from your use of, participation in, or inability to participate in the Masterclass. Our total aggregate liability for any and all claims arising out of or relating to the Masterclass shall not exceed the amount you paid us for the Masterclass in the twelve months preceding the event giving rise to the claim.

Nothing in this Section limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, fraud, wilful misconduct, or any non-waivable statutory consumer rights.

11. Indemnity

You agree to indemnify and hold harmless Blue Dot Transform Consulting Pvt. Ltd., its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Masterclass or materials.

12. Force majeure

We are not liable for any failure or delay in performance that results from causes beyond our reasonable control — including acts of God, natural disaster, war, terrorism, riot, government action, labour dispute, internet or utility outage, or third-party platform failure (e.g., Zoom, Razorpay, Meta, Google). Where a live session is prevented by a force-majeure event, we will make reasonable efforts to reschedule or provide a recording.

13. Termination

We may suspend or terminate your access to the Masterclass, community, or bonus materials at any time if you materially breach these Terms, engage in fraud or abuse, or if required by law. On termination, the licences granted to you under Section 6 immediately end. Sections 6, 8, 10, 11, 14, and 16 survive termination.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent.

15. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated by email or on this page at least 14 days before they take effect; continued use of the service after the effective date constitutes acceptance.

16. Governing law & dispute resolution

These Terms are governed by the laws of India (excluding conflict-of-laws principles). Subject to your non-waivable consumer rights in your country of residence, any dispute arising out of or in connection with the Masterclass shall be subject to the exclusive jurisdiction of the competent courts located in the registered-office city of Blue Dot Transform Consulting Pvt. Ltd.

Before initiating any formal action, both parties agree to attempt in good faith to resolve the dispute by informal discussion — please write to support@avinashanandsingh.com with the subject "Dispute" and describe the issue.
